Probate and Estate Administration
Probate and estate administration is the process of distributing the deceased’s estate to his or her descendants.
That person’s estate will then be subject to probate court. In probate court, the decedent’s will, if any, will be challenged or validated. If validated, the estate will undergo an accounting and the decedent’s assets will be distributed to his or her named beneficiaries. When the decedent does not have a will, his or her assets will pass pursuant to law.
An estate administrator must ensure that the terms of the will are carried out in an efficient and expeditious manner. He or she will work closely with the family to reduce conflict and add clarity to the process. By hiring an attorney to act as an estate administrator, a family may unburden itself with the difficulties of effectuating a will and can instead focus on more pressing and personal matters.
